The Legal Problem
IEC 61508:2010 Functional Safety of Electrical/Electronic/Programmable Electronic Safety-Related Systems (E/E/PE) is the foundational functional safety standard for safety-critical electronics outside the automotive domain. Industrial control systems, medical devices, railway signaling, power grid infrastructure, and process industry safety instrumented systems (SIS) all fall within its scope unless a domain-specific standard (ISO 26262, IEC 62061, EN 50128, IEC 61511) applies instead.
The legal significance of IEC 61508 has grown substantially as regulators and courts increasingly look to published safety standards to define the applicable standard of care. A manufacturer of a Safety Integrity Level 3 (SIL 3) safety function who cannot demonstrate compliance with IEC 61508 Part 3 requirements for systematic capability faces substantial product liability exposure in the event of a safety-related failure.

The safety manual delivered with a certified IEC 61508 subsystem defines the conditions under which the SIL claim is valid. If a system integrator uses a certified subsystem outside the conditions specified in the safety manual, the SIL claim is voided — and the integrator assumes the product liability exposure that the certification was intended to address. This is one of the most common and costly IEC 61508 legal mistakes.
